Welcome to Sanwariyaelectronics.com (also referred to as “we,” “us,” “our,” or “SM Electronics”). These Terms & Conditions (“Terms”) govern your access to and use of our website and services. By accessing or using this website, you agree to be bound by these Terms, our Privacy Policy, Return & Refund Policy, and any other policies referenced herein. If you do not agree with any part of these Terms, please do not use the website.

SM Electronics is the trade name of Sanwariya Mobile & Electronics, a sole proprietorship/firm registered under Indian law. Our registered shop and warehouse is at:

We are a retailer and wholesaler of consumer electronics, including new and refurbished mobile phones, laptops, accessories, power banks, earphones, smartwatches, speakers, refrigerators, coolers and related products (“Products”).
2. Eligibility & Acceptable Use
- Age and Capacity. You must be 18 years or older and capable of forming a binding contract under Indian law to make purchases. Minors may only use the site under parental or guardian supervision; the supervising adult is responsible for all activities.
- User Conduct. You agree not to:
- Access or use our site in any unlawful or fraudulent manner;
- Attempt to hack, compromise data or disrupt the network;
- Transmit malicious code or engage in spamming/phishing;
- Create false identities or multiple accounts;
- Use automated bots for scraping, purchasing or posting;
- Post content (reviews/comments) that is defamatory, obscene, infringing, threatening, or violates privacy rights.
We may suspend or terminate your account for non‑compliance or suspected fraud.
3. Products & Descriptions
- Product Range. We sell new mobile phones, refurbished phones, accessories (chargers, power banks, headphones), smartwatches, speakers, refrigerators, air coolers and other electronics (“Products”).
- Authenticity & Certifications. We source genuine products from authorised distributors or original manufacturers. Electronics requiring mandatory safety certifications (e.g., BIS, IS 13252, IS 616) are certified as per Indian standards.
- Product Listings. We strive to provide accurate descriptions, specifications, prices, images and features. However:
- Photographs are illustrative; actual colours, packaging or dimensions may vary.
- Certain features (e.g., OS version) may differ due to updates by manufacturers.
- We reserve the right to correct typographical errors, inaccuracies or omissions and to update information at any time without prior notice.
- Refurbished Items. These items are pre‑owned but tested for functionality and quality. They may show minor signs of prior usage. Their packaging might not be original.
4. Pricing, Payment & Taxes
- Pricing. All prices are in Indian Rupees (INR) and include applicable GST unless otherwise specified. Prices and offers may change without notice until an order is accepted and processed.
- Payments. We accept UPI, debit/credit cards, net banking, wallets and cash on delivery (where available). Payments are processed through RBI‑authorized payment aggregators and gateways (e.g., Razorpay). We do not store full card details; payment data is tokenized and handled by PCI‑DSS compliant processors.
- Security. Transactions are encrypted using SSL/TLS technology. We adhere to 2‑factor authentication (OTP) for card payments in compliance with RBI and card network regulations.
- Invoice & Taxes. You will receive a tax invoice via email or with your shipment. Prices include duties or taxes as per applicable law.
- Pricing Errors. If a Product is listed at an incorrect price due to technical or human error, we reserve the right to refuse or cancel any orders placed for that Product. Any payment collected for such orders will be refunded.
5. Order Process, Acceptance & Cancellation
- Order Placement. When you place an order, it is an offer to purchase. We may refuse or cancel any order for reasons including limitation on quantities available, inaccuracies or errors in product or pricing information, or suspected fraud.
- Confirmation & Acceptance. After placing an order, you will receive an order acknowledgement via email/SMS. A binding contract is formed only when we dispatch the product and send a dispatch confirmation.
- Customer Cancellation. You may request cancellation before dispatch by contacting support. After dispatch, the order cannot be cancelled; you may initiate a return under Section 7.
- Seller Cancellation. We reserve the right to cancel orders due to unavailability, regulatory restrictions, payment issues, or at our discretion. We will notify you and refund any amounts paid.
- Order Modification. Once an order is processed, changes to address, phone number or items may not be possible. Please double‑check details before finalizing.
6. Shipping & Delivery
- Shipping Coverage. We ship across India using reputed logistics partners (e.g., Shiprocket, Delhivery, India Post).
- Delivery Timelines. Estimated delivery times are displayed at checkout and vary by location, product type and warehouse. These estimates are not guaranteed.
- Shipping Charges. Charges are calculated based on product weight, dimensions, destination and shipping speed. They will be displayed at checkout.
- Dispatch & Tracking. Once dispatched, you will receive tracking details.
- Delivery Attempts & Responsibility. Our partners will attempt delivery multiple times. If the address is incorrect or no one is available to receive the package, it may be returned to us. Reshipping may incur additional charges.
- Risk & Title. The title and risk of loss transfer to you upon delivery. We are not liable for loss or damage after delivery unless it is due to our negligence.
7. Return, Replacement & Refund Policy
Our Return Policy aims to provide clarity and fairness:
- Eligibility for Return. Returns are accepted within 7 days of delivery for items that are:
- Defective, damaged or dead on arrival (DOA);
- Incorrect or missing items;
- Not as described.
- Products must be unused, uninstalled (where applicable) and in the same condition as delivered, with all accessories, tags, manuals, warranty cards and original packaging.
- Exclusions. We do not accept returns for:
- Products damaged due to misuse, mishandling, accidents or unauthorized repairs;
- Products with missing serial numbers or tampered warranty stickers;
- Software licenses, digital downloads or consumables (such as batteries or ear cushions) once opened;
- Non‑returnable categories (clearly marked as non-returnable on the product page) unless defective.
- Return Procedure.

- Provide your order number, photos and an unboxing video showing the damage/defect.
- Our team will evaluate your claim and guide you through return shipping or service center visits.
- Replacement vs Refund. We will attempt to replace defective items with the same model. If replacement is unavailable, we will offer a refund or credit. Refunds are processed via the original payment method within 7–10 business days after approval.
- Return Shipping. For approved returns, we arrange courier pickup where available. In remote locations, you may be asked to ship the item to us. Return shipping costs in legitimate cases are borne by us.
- Inspection. All returned items are inspected. If the product fails the inspection (e.g., signs of misuse), your return may be rejected or a restocking fee may be charged.
8. Warranties & After‑Sales Support
- Manufacturer Warranty. All new electronic devices include manufacturer’s warranty as per the brand’s terms (usually 6–24 months). You must retain the original invoice and contact the brand’s authorized service center for warranty claims. SM Electronics will assist in guiding you to the right service center but does not directly perform warranty repairs.
- Seller Warranty (Refurbished Items). Refurbished items typically come with a limited seller warranty (e.g., 7 days) covering hardware defects on arrival. After this period, service may be chargeable.
- Service Centers. Some large appliances (air conditioners, refrigerators) require installation by authorized personnel to remain eligible for replacement/repair. Failure to use authorized installation may void returns.
- Warranty Exclusions. Warranty does not cover:
- Physical or liquid damage, voltage fluctuation, acts of nature, theft or loss;
- Software glitches, viruses or compatibility issues;
- Consumables like ear tips, covers, protective films, or accessories unless specifically covered by the manufacturer.
9. User Account & Security
- Account Creation. When you register, you agree to provide accurate and current information. If your information changes, please update it promptly.
- Credentials. You are solely responsible for safeguarding your login credentials. You agree to notify us immediately of any unauthorized use. We may require additional verification or suspend accounts if suspicious activity is detected.
- Termination. We reserve the right to suspend or terminate your account for fraud, breach of these Terms or misuse. You may close your account at any time by contacting support, though certain obligations (e.g., outstanding payments) remain.
10. Intellectual Property
- Ownership. All content on Sanwariyaelectronics.com—including text, graphics, logos, images, product descriptions, videos, software and trademarks—is the property of SM Electronics or its licensors and is protected by Indian and international copyright and trademark laws.
- Limited Licence. We grant you a limited, non‑exclusive, non‑transferable licence to access and use the website for personal shopping. You may not copy, modify, distribute, reproduce, republish, upload, transmit or sell any part of the website without our prior written consent.
- User‑Generated Content. By submitting reviews, comments or other content, you grant us a worldwide, perpetual, royalty‑free licence to use, reproduce, modify and display such content in connection with our services. We may moderate or remove user content that violates laws, these Terms or community standards.
11. Privacy & Data Security

12. Environmental Responsibility & E‑Waste

- Take‑Back Program. If you wish to dispose of your old mobile phone or electronic item purchased from us, contact our support. We provide guidance on returning the product to authorized collection centers or recyclers. Do not dispose of e‑waste in general waste bins.
- Battery Disposal. Rechargeable batteries contain hazardous substances. Please return used batteries to designated recycling points or e‑waste collection centers.
13. Limitation of Liability
- Indirect Damages. To the fullest extent permitted by law, SM Electronics shall not be liable for any indirect, incidental, special, punitive or consequential damages arising out of your use of the website or Products.
- Maximum Liability. Our total liability for any claim arising under these Terms or sale of Products, whether in contract, warranty, tort (including negligence) or otherwise, shall not exceed the amount paid by you for the Product in question.
- No Warranty. We provide the website “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the website will be uninterrupted, error‑free or free from viruses or other harmful components.
- Consumer Rights. These limitations do not exclude any statutory warranties or consumer rights that cannot be excluded under applicable laws (e.g., rights under the Consumer Protection Act 2019).
14. Indemnification
You agree to indemnify and hold harmless SM Electronics, its owners, directors, employees, agents and affiliates from any claims, liabilities, damages, costs and expenses (including legal fees) arising out of your misuse of the website, violation of these Terms, infringement of any intellectual property or other rights or violation of law.
15. Governing Law & Dispute Resolution
- Applicable Law. These Terms shall be governed by and construed in accordance with the laws of India.
- Jurisdiction. The courts of Udaipur, Rajasthan shall have exclusive jurisdiction over any dispute arising from or relating to these Terms, your use of the website or the sale of Products, subject to consumer protection laws allowing consumers to file complaints in their own jurisdictions.
- Alternative Dispute Resolution. In case of any dispute, the parties may first attempt to resolve it through negotiation or mediation. If unresolved, disputes may be referred to arbitration under the Arbitration & Conciliation Act 1996 (as amended), with a sole arbitrator appointed by mutual consent. The seat of arbitration shall be Udaipur, Rajasthan. The language of arbitration shall be English.
16. Amendments & Updates
We may amend these Terms at any time. Updated versions will be posted on the website with the “last updated” date. Continued use of the website after any change constitutes acceptance of the revised Terms. It is your responsibility to review the Terms periodically.
17. Severability
If any provision of these Terms is held invalid, unlawful or unenforceable under applicable law, such provision shall be severed and the remaining provisions shall continue in full force and effect.
18. Force Majeure
We will not be liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to acts of God, war, terrorism, strikes, labour disputes, lockdowns, epidemics, natural disasters or disruptions in telecommunications, power or transportation.
19. Entire Agreement
These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy and other policies made available on the website, constitute the entire agreement between you and SM Electronics regarding your use of the website and purchase of Products. They supersede any prior agreements or understandings (oral or written).
